News from the firm

What will happen to my inheritance
if I divorce?

Is your inheritance at risk if you divorce? This is a real worry for many divorcing couples and a question we are often asked to advise upon.

A recent Court of Appeal case has set out some useful guidelines which Wendy Ryle comments on in her article.

Disputing Wills
and claims against estates

Disputing Wills and making claims are a big growth area.

For families dealing with a bereavement the last thing they want is a claim against them.

Many of those claims seem to have little merit or are brought by individuals whom the deceased did not wish to benefit.

Since 1975, members of the deceased's family as well as individuals who were being looked after by the deceased or treated as a member of the family can bring a claim.

It is essential that your Will is properly drawn, that you think about those persons who might to expect benefit under your Will and we have on file information as to why a particular individual is not being benefited to the extent that they might expect.

Accurate information and a properly drawn Will are key to successfully defending claims.

If you feel your Will is at risk from a claim or you would like an initial chat then let us know!

We hope you don't get involved in dispute, but if you do
here are 7 reasons to instruct us!

1. Initial fixed price consultation to assess and advice upon the legal merits of your case

2. Proper examination of the strengths and weaknesses of the evidence you have to support your case.

3. Analysis of the likely cost to you and the benefit that could be secured. This gives you the chance to form a view as to whether it is economic to proceed.

4. Monthly progress checks and review of costs incurred and estimated future costs and likely progress of matter.

5. Tactical advice as to how to put your opponents at a disadvantage and increase their liability to pay your costs.

6. Credit check report on your opponent for actions involving businesses and companies to test their ability to pay.

7. Expert team of mediators available to resolve the case without court hearings (there are many advantages to mediation).
