Probate

Coping with the death of a loved one or a close friend, imposes great strains on you and on your family. But at the same time, the Executor, who is often a close relative or friend, has to start complying with the provisions of the Will.

An Executor is under strict legal obligations to ensure that the debts of the deceased are dealt with, and the remaining assets are distributed in accordance with the terms of the Will.

If there is no Will the burden can be even greater. The closet surviving relatives will be responsible for sorting out the estate and then sharing out in accordance with the Administration of Estates Act 1925.

Since the Firm was founded over 100 years ago, we have looked after families, in some cases through three generations.

We have considerable experience in dealing with Probate and administration matters.

We will explain clearly what is involved and deal with all aspects of the estate including:

  • Obtaining the grant of probate or administration
  • Inheritance tax on assets
  • Capital gains tax return for the period during which the estate is being dealt with

  • Advising on and dealing with the sale of any property
  • Collecting in and distributing the assets amongst the beneficiaries
  • Executor's income tax return
  • Probate and administration matters vary considerably in their complexity. Whatever the size of the estate, from a few hundred pounds to many millions, we can deal with it, and help the Executors comply with legal obligations
  • Executors and beneficiaries are sometimes concerned with the time it that is taken for an estate to be dealt with and the cost involved

We will explain clearly at the beginning of a matter how and when we will charge, and provide an estimate of these charges as soon as details of the estate are known.

We will also provide you with an estimate of the length of time it will take to complete the matter. Throughout the matter we will tell you at regular intervals what progress is being made and what further action is required to complete the matter.
