Newly built properties are sold either “Off-plan” or “On Plan” (sometimes called “built out”):

Off Plan

“Off Plan” means the property is not built, so the buyer is buying the property off a plan rather than after a visual inspection. Very often a reservation fee is paid when an offer is accepted so it is important to check whether the deposit is refundable. We will check the developer’s title, planning position and most importantly that there are safeguards in the contract to ensure the built out property matches the buyer’s expectations in terms of design, quality and timing of completion.

To commit to buying a property before it has been built will feel like a significant leap of faith in the developer but our experience in this area enables us to give reassurance to our clients.

On Plan

“On Plan” or “Built Out” means the property has been constructed before contracts are exchanged. We will check that the property construction has been completed in accordance with planning permissions and other consents and make sure it will be acceptable for registration of the first title of the property at the Land Registry. Usually new rights and obligations for the property will be created such as a right of way or an obligation to contribute to the costs of maintenance of an area of common use all of which need to be checked carefully.
